Child Custody in Texas

In Texas, child custody is known as “conservatorship,” which is used to describe the legal responsibilities and rights of a parent. Unless both parents can come to an agreement about conservatorship after a divorce, the matter will need to be settled in court. There are two types of conservatorship in Texas: Sole managing conservatorship (SMC) and joint managing conservatorship (JMC). As the names imply, this means that either one or both parents, respectively, will be granted the legal right to make certain decisions about how the child is raised. Sole conservatorship is typically granted in cases where the other parent has a history of drugs or alcohol abuse, criminal activity, neglect, or violence, or if they have largely been absent from the child’s life. In these cases, visitation may or may not be granted to the non-conservator.
